Hmm, I just tried to reproduce this one on Ubuntu 12.10 but without any
luck.
I used a 8GB flash drive, with yesterday's amd64 desktop image. Used
usb-creator with 4GB of persistent space, then followed your
instructions and I successfully got a qwertz layout on the first boot
and an azerty layout on the second...

TEST CASE
1. Boot a live USB with persistence
2. At ubiquity greeter, select 'Deutsch'
3. Select 'Ubuntu ausprobieren' and let the live session start
4. Reboot
5. In syslinux, select 'French'
6. Select 'Essayer Ubuntu', press 'Enter' and let the live session start
EXPECTED RESULT
The keymap is set to 'fr'
ACTUAL RESULT
It is set to 'de' and the keyboard indicator lists german keymaps.
The screenshot shows that the desktop is localized in French (label of the install icon is 'Installer Ubuntu') but the keyboard indicator lists german layouts.
