This appears to still be unfixed in linux-image-2.6.10-5-amd64-{generic,k8-smp}, which is what I believe is 
currently in Hoary. I just upgraded the machine which caused me to notice this bug in the first place to 
Hoary, and noticed a message at boot, which corresponds to these lines in /var/log/kern.log :  
  
 Apr  5 13:12:03 localhost kernel: 3ware 9000 Storage Controller device driver for Linux v2.26.02.001.  
 Apr  5 13:12:03 localhost kernel: ACPI: PCI interrupt 0000:02:02.0[A] -> GSI 26  
(level, low) -> IRQ 26  
 Apr  5 13:12:03 localhost kernel: scsi_proc_hostdir_add: proc_mkdir failed for <NULL>  
 Apr  5 13:12:03 localhost kernel: scsi0 : 3ware 9000 Storage Controller  
  
'cat /proc/version' for the kernel that the above log refers to returns:  
 Linux version 2.6.10-5-amd64-k8-smp (buildd at crested) (gcc version 3.3.5 (Debian 1:3.3.5-8ubuntu2)) #1 SMP Fri  
Apr 1 18:23:25 BST 2005  
  
So this may be fixed in the installer/boot images, but unless it's fixed in the actual normal kernel images,  
it'll cause problems on an upgrade or new kernel install when it tries to create the matching initrd.img file.
