yes, this works with unionfs, because they use a hand-crafted Makefile.

If you try e.g. btsco (from http://sourceforge.net/projects/bluetooth-alsa),
which goes the (preferred) way of just using the kernel's buildsystem/Makefile,
it doesn't work, because that relies on the Makefile in
/lib/modules/2.6.12-7-686/build to be correct.
