A few things to consider:

One question - does Ubuntu use any special options when this driver is loaded? 
If so, then does the fact
that the driver is unloaded and then reloaded have any bearing on the situation?
 Also, is the name/location Ubuntu uses for the firmware the same as the driver
default?
