After a reboot and using 
sudo modprobe -r iwl3945 ; sudo modprobe iwl3945 disable_hw_scan=1

I'm seeing both errors in one run :

ioctl[SIOCSIWENCODEEXT]: Invalid argument
ioctl[SIOCSIWSCAN] Device or resource busy
