It might be easiest to just checkout the git tree:

sudo apt-get install git-core
git clone git://git.kernel.org/pub/scm/linux/kernel/git/torvalds/linux-2.6.git
cd linux-2.6
git checkout -b 2.6.28-rc9 v2.6.28-rc9
