Yes, still an issue as of 2.6.31-20-generic in Karmic.

The good news is that I figured out a work-around:

It's not clear to me that you want to spend a lot of developer 
resources on this one.  It's definitely a kind of weird edge case
that's really only interesting to forensic analysts like me, and
there is a simple work-around.  It's also arguable that the current
behavior is "correct" from some points of view.
