The patch is already applied to oracular (but not released yet):

The backport you mention is a follow-up fix for a build issue with an
oracular upstream stable patchset
(https://bugs.launchpad.net/ubuntu/+source/linux/+bug/2109301) that has
already been applied and contains the offending patch.
