This behavior is still there in gutsy.  I get the error message:

Device "devicename" is already in use by other applications
(kio_audiocd, kio_audiocd).  It is highly recommended that you quit
those before continuing.  Otherwise kb3 might not be able to fully
access the device.

I can choose to continue and everything seems to function as
expected/normal.  However this is irritating when you are backing up
100's of CDs.
