It actually is intent behavior, the box exhibited in the second screenshot is a passive focus, once an item got focused it will stick with the focus (either active or passive) until you either change the focus or the directory.
A passive focus basically means that you will be able to navigate with your keyboard to any item relative from the one with passive focus, where in the process of navigation an active focus gets used again. But for example if you have a passive focus and press the contextmenu key of your keyboard (assuming it has one) it will open the contextmenu for the folder and not the item with passive focus (while you will get the item's context menu if it got an active focus).
