I would keep on eye on the bitrate of the videos that are having subtitle issues.  If one encodes a video at a very high bitrate, many players will have trouble playing them properly and it would make sense that a subtitle or two might get skipped (especially the subtitle at the very start; since these videos are not hinted for streaming).

Whatever bitrate you're encoding at, try knocking it down by 500 or 1000 kbps and see what happens.

That's my guess, anyway.
