[DC LoCo] When did Fruit Loops become Open Source cereal?

What is the legality of this issue, can anyone use Tux in any manner they
see fit? I'm not up on the law so I thought maybe someone on here can
provide some more information about this. I mean what would keep M$ from
doing a viral based FUD campaign using Tux's image.
