I think you pretty much have answered you own question already ! ;-)
If you feel Ubiquity doesn't behave properly with regard to the size of
the root partition... just file a bug about it, as we on this list
can't do much about it.
As for my own experience, I installed Feisty
Herd 5 with Ubiquity recently, on a 5.5GB partition for root, and
I didn't get any warning, it just worked.
