to further test this issue as i belive the bug is related to a kernel change i have installed the following
linux-headers-3.8.0-030800_3.8.0-030800.201302181935_all.deb
linux-image-3.8.0-030800-generic_3.8.0-030800.201302181935_i386.deb
linux-headers-3.8.0-030800-generic_3.8.0-030800.201302181935_i386.deb

and tested if i see the same issue.... and i do

  after seeing this bug i tried booting 3.5.0-24-generic #38-Ubuntu SMP Mon Feb 18 23:28:26 UTC 2013 i686 i686 i686 GNU/Linux and i did not see the bug
